Agreement and licence
By installing or using the app, you agree to this EULA. Martin Cheníček grants you a limited, personal, revocable, non-exclusive, non-transferable licence to use the app on devices you own or control, subject to the rules of the app store through which you obtained it. The app is licensed, not sold.
Restrictions
You may not copy, distribute, rent, lease, sell, sublicense, reverse engineer, decompile, bypass security, interfere with the service, use the app unlawfully or remove proprietary notices, except to the limited extent such restriction is prohibited by mandatory law.
Accounts and service features
Some features require a Pimp Your Life account and network connection. You are responsible for accurate information and credential security. Course requests are governed by the Terms and Conditions; the app does not itself create a confirmed reservation or process an online payment.
Safety and no medical advice
Freediving, breath-hold, water, travel and sports activities can be dangerous. App content is informational and organisational, not medical advice, diagnosis, emergency guidance or a substitute for qualified in-person instruction. Never practise breath-hold activities alone or in water without appropriate trained supervision, and follow all instructor and local safety rules.
Privacy
Use of personal data is described in the Privacy Policy. If the app allows account creation, you can initiate deletion from the account area or use the public Account Deletion page.
Third-party services and connectivity
The app may rely on operating-system, app-store, hosting, email, maps, links or push-notification services supplied by third parties. Their own terms may apply. We are not responsible for third-party services outside our reasonable control, but this does not affect rights that cannot be excluded by law.
Updates, availability and termination
We may provide updates, change or discontinue features where reasonably necessary for security, law or service development. You may stop using and uninstall the app at any time. This licence ends if you materially breach it; upon termination you must stop using and remove the app. Provisions intended to survive remain effective.
Warranty and liability
The app is provided with the care required by applicable law. To the extent permitted by law, no promise is made that it will be uninterrupted, error-free or suitable for every purpose. Nothing excludes mandatory consumer rights or liability that cannot lawfully be excluded, including for intent, gross negligence or personal injury.
Apple-specific terms
If downloaded from Apple's App Store, this agreement is between you and Martin Cheníček, not Apple. Apple is not responsible for the app or its support. To the extent any warranty is not effectively disclaimed, Apple may refund the purchase price, if any, and has no other warranty obligation to the maximum extent permitted by law. Martin, not Apple, is responsible for product claims, legal compliance and intellectual-property claims. You represent that you are not located in an embargoed country and are not on a prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it.
Google Play terms
If downloaded from Google Play, Google is not a party to this EULA and is not responsible for the app, support, claims or warranties. Your use must also comply with the Google Play Terms of Service and applicable device or carrier terms.
Law and complete agreement
Czech law applies without removing mandatory consumer protection in your country of residence. This EULA, the Privacy Policy, the service Terms and applicable app-store rules form the agreement relevant to your use. If a provision is invalid, the remaining provisions continue to apply.
